Naked Ape Official is a South African luxury fashion house founded by Shaldon Kopman. We specialise in bespoke, tailor-made garments crafted from sustainable, biodegradable textiles in South Africa. Acceptance of Terms

By accessing or using nakedapeofficial.com, creating an account, or placing an order, you confirm that you are at least 18 years of age and that you agree to these Terms and Conditions in full.

If you do not agree with any part of these terms, please do not use our website or services. These terms apply to all visitors, registered users, and customers.

 

Ordering & Contract Formation

Placing an order on nakedapeofficial.com does not in itself constitute a binding contract. A contract is formed only when we send you an order confirmation email confirming that your order has been accepted and payment received.

We reserve the right to refuse or cancel any order at our discretion - for example, where a product is out of stock, a pricing error has occurred, or we are unable to verify payment. In such cases, a full refund will be issued promptly.

It is your responsibility to ensure that all order details - including delivery address, measurements (for bespoke orders), and contact information - are accurate at the time of submission.

 

Bespoke & Custom Orders

Many of our garments are made-to-order or bespoke, tailored to your individual specifications. The following terms apply specifically to custom and bespoke orders:

All measurements, specifications, and design preferences must be confirmed in writing (via email or order form) before production begins.

Once production has commenced, bespoke orders cannot be cancelled and are not eligible for a refund on change-of-mind grounds. This is consistent with the Consumer Protection Act's provisions for special-order goods.

A 50% deposit is required to initiate production on bespoke orders. The remaining balance is due prior to dispatch.

Lead times for custom garments typically range from 4 to 8 weeks depending on complexity, fabric availability, and our current production schedule. You will be informed of the estimated lead time at the time of order.

Minor variations in fabric texture, colour, or finish may occur between different production runs. These are inherent to the use of natural, sustainable textiles and do not constitute a defect.

 

Pricing & Payment

Prices

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices are subject to change without prior notice; however, orders confirmed before a price change will be honoured at the original price.

Payment Methods

We accept the following payment methods:

·       Credit and Debit Card (Visa, Mastercard) via our secure payment gateway

·       EFT / Instant EFT

·       Additional payment options as displayed at checkout

·       All card payments are processed securely by our payment provider. We do not store, access, or retain your card details.

Failed or Declined Payments

If payment is declined, your order will not be processed. Please ensure sufficient funds are available or contact your bank before attempting again. If you experience repeated issues, contact us at info@nakedapeofficial.com.

 

Delivery & Shipping

Domestic Delivery (South Africa)

We deliver to all major centres across South Africa. Standard delivery is fulfilled via a reputable courier service. Estimated delivery times are:

Delivery fees are calculated at checkout and vary based on location and order size.

International Delivery

We offer international shipping on a case-by-case basis. Please contact us directly at info@nakedapeofficial.com to arrange international orders and receive a shipping quote.

Risk & Title

Risk in the goods passes to you upon delivery. Title passes upon full payment being received.

Delays

While we make every effort to meet estimated delivery windows, we cannot be held liable for delays caused by courier services, weather, or events beyond our reasonable control (force majeure). In the case of a significant delay, we will contact you and provide options.

 

Returns, Exchanges & Refunds

Ready-to-Wear Items

We accept returns on ready-to-wear (non-bespoke) items within 14 days of delivery, provided that:

·       The item is unworn, unwashed, and in its original condition with all tags attached

·       The item is returned in its original packaging

·       Proof of purchase is provided

·       Items that show signs of wear, damage, or alteration will not be accepted for return.

 

Bespoke & Made-to-Order Items

Bespoke garments are made specifically for you and cannot be returned or refunded on grounds of change of mind, as permitted under the Consumer Protection Act for special-order goods. Returns are only accepted if the garment contains a manufacturing defect (see below).

 

Defective Items

If you receive a garment that is defective due to a manufacturing fault, please contact us within 7 days of delivery with a description and photographic evidence. We will, at our discretion, offer:

·       A repair or alteration at no cost

·       A replacement garment

·       A full or partial refund

Return Process

To initiate a return, email info@nakedapeofficial.com with your order number and reason for return. We will provide a return reference number and shipping instructions. Items returned without prior authorisation will not be processed.

Return shipping costs are the responsibility of the customer unless the item is defective.

Refunds

Approved refunds will be processed within 7 – 10 business days of receiving and inspecting the returned item. Refunds will be issued via the original payment method.

 

Consumer Rights (CPA)

These terms are subject to the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002. Where any provision of these terms conflicts with the CPA, the provisions of the CPA shall prevail.

Under the CPA, consumers are entitled to:

·       Goods that are safe, of good quality, and free from defects

·       Honest and accurate product information

·       Fair, reasonable, and honest dealing

·       A 5-business-day cooling-off period for goods purchased as a result of direct marketing (this does not apply to bespoke or made-to-order goods)

 

 

 

Product Descriptions & Accuracy

We take care to ensure that all product images, descriptions, and specifications are as accurate as possible. However, please note the following:

·       Colours may appear slightly different on screen depending on your device's display settings.

·       Natural textiles - including cotton, linen, wool, hemp, bamboo, and silk - may carry slight variations in texture, tone, and weight. These are characteristics of natural materials and are not defects.

·       Measurements and sizing guides are provided as a reference; for bespoke orders, your provided measurements will govern.

If you have specific questions about a product before purchasing, please contact us before placing your order.

 

Intellectual Property

All content on nakedapeofficial.com - including but not limited to text, photographs, design work, graphics, garment designs, lookbooks, videos, and branding - is the intellectual property of Naked Ape Official and is protected by South African and international copyright law.

You may not reproduce, copy, distribute, publish, or use any of our content for commercial purposes without prior written permission. For collaboration or licensing enquiries, contact info@nakedapeofficial.com.

Purchasing a garment does not transfer any intellectual property rights. The design copyright of all Naked Ape garments remains with Naked Ape Official.

 

User Accounts

If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Please notify us immediately at info@nakedapeofficial.com if you suspect any unauthorised use of your account. We reserve the right to suspend or terminate accounts that engage in fraudulent, abusive, or unlawful activity.

 

Prohibited Use

You agree not to use nakedapeofficial.com to:

·       Engage in any unlawful, fraudulent, or harmful activity

·       Attempt to gain unauthorised access to our systems or the accounts of other users

·       Scrape, harvest, or systematically collect data from the website

·       Upload or transmit any malicious software, spam, or disruptive content

·       Impersonate Naked Ape or any of its representatives

·       Infringe the intellectual property rights of Naked Ape or any third party

We reserve the right to restrict access to any user who violates these terms.

 

Limitation of Liability

To the maximum extent permitted by South African law, Naked Ape Official shall not be liable for:

·       Indirect, consequential, or incidental loss or damage arising from your use of our website or products

·       Loss of data, revenue, business, or reputation

·       Delays caused by third-party couriers, payment processors, or force majeure events

·       Our total liability to you in connection with any claim shall not exceed the value of the order to which the claim relates.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded under the Consumer Protection Act or other applicable law.

 

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these terms shall be subject to the jurisdiction of the South African courts, or resolved through mediation in the first instance.

 

 

Changes to These Terms

We reserve the right to update or amend these Terms and Conditions at any time. Changes will take effect from the date they are published on this page, indicated by the "Last Updated" date at the top.

We encourage you to review these terms periodically. Your continued use of the website or placement of orders after any changes constitutes acceptance of the revised terms.
